Nerukoneko Terms of Use
These Terms of Use (the "Terms") set out the conditions for using the game app "Nerukoneko" (the "App"), provided by PanMarie Studio (the "Studio"). Please read these Terms carefully before using the App. By using the App, you are deemed to have agreed to all of these Terms.
Article 1 (Agreement to These Terms)
1. These Terms apply between the Studio and the user with respect to the use of the App.
2. If you do not agree to the content of these Terms, please do not use the App.
Article 2 (Nature of the App)
1. The App is an entertainment game for spending a quiet moment before sleep together with Chopin the cat.
2. The App is not a medical device and is not intended to diagnose, treat, or prevent sleep disorders or any other illness. It does not guarantee any particular outcome, such as falling asleep more easily or improving the quality of your sleep. Results vary from person to person.
Article 3 (About the Notes on the Science of Sleep)
The content relating to the "science of sleep" that appears in the App and on its related pages is a factual introduction to published research reports, and does not guarantee any effect. If concerns about your sleep continue over a long period, please do not rely on the App, but consult a specialist such as a medical institution. The App is not a substitute for seeing a medical professional.
Article 4 (A Note on Safe Use)
1. In a dark room before sleep, please keep a comfortable distance from the screen and use a reasonable volume. If you use earphones, we recommend a small, gentle volume that is kind to your ears.
2. The App is a game designed with the expectation that you may fall asleep while lying down. Please place your device where it will not fall onto your face and in a spot where it is unlikely to overheat.
3. Please do not use the App while driving a car or bicycle, or while walking.
Article 5 (About the Displayed Figures)
The figures displayed by the App, such as star fragments and records, are based on records kept within your device, and their accuracy and completeness are not guaranteed. Please treat these figures only as a rough guide.
Article 6 (Operating Environment)
The App is designed to run on the devices and operating systems that the Studio has stated it supports. The Studio makes no guarantee regarding malfunctions arising from your device's model, operating system version, or settings, or regarding the App failing to operate correctly.
Article 7 (Use by Minors)
1. If you are a minor, please use the App only after obtaining the consent of a parent, guardian, or other legal representative.
2. Regardless of age, the App does not collect personal information such as names, email addresses, location data, or advertising identifiers.
Article 8 (Intellectual Property Rights)
All intellectual property rights in the App and in the text, images, music, characters, programs, and other materials contained in it belong to the Studio or the rightful rights holders. You may not reproduce, modify, reprint, distribute, or use these for commercial purposes without the Studio's prior consent.
Article 9 (Limitation of Liability)
1. The Studio makes no warranty, whether express or implied, as to the accuracy, completeness, or usefulness of the information provided in connection with the App.
2. Where a user suffers ordinary, direct damage due to the Studio's non-performance of obligations or a tort (excluding damage caused by the Studio's willful misconduct or gross negligence), the Studio's liability for damages shall be limited to a maximum of 10,000 yen, in view of the fact that the App is provided free of charge.
3. Notwithstanding the preceding paragraph, in the case of the Studio's willful misconduct or gross negligence, the limit in the preceding paragraph shall not apply, and the Studio shall bear liability for damages in accordance with applicable law.
4. The Studio bears no liability for damage arising from special circumstances, lost profits, or indirect damage (except in the case set out in the preceding paragraph).
Article 10 (Relationship with the App Store)
These Terms set out the conditions of use specific to the App. Matters relating to downloading and licensing from the App Store are governed by Apple's standard Licensed Application End User License Agreement.
Article 11 (Changes to These Terms)
The Studio may change these Terms as necessary. The changed Terms take effect from the time they are displayed within the App or by a method determined by the Studio. If you use the App after a change, you are deemed to have agreed to the changed Terms.
Article 12 (Severability)
Even if any provision of these Terms is determined to be invalid or unenforceable under applicable law, the remaining provisions of these Terms shall continue to remain in full force and effect.
Article 13 (Governing Law and Jurisdiction)
The interpretation and application of these Terms shall be governed by the laws of Japan. If a dispute arises between the Studio and a user in connection with the use of the App, the court having jurisdiction over the location of the Studio's head office shall be the exclusive court of first instance by agreement.
